Abstract
Toplumların kutsallık atfettiği dini değerlerle çatışan ifadeler söz konusu olduğunda; dini hassasiyetleri korumak amacıyla ifade özgürlüğüne müdahale edilip edilemeyeceği ve şayet edilecekse bu müdahalenin sınırlarının nasıl çizileceği çalışmanın temel sorusunu oluşturmaktadır. Bu doğrultuda, çalışmada öncelikle İnsan Hakları Avrupa Sözleşmesi’nde ve Türk Anayasası’nda güvence altına alınan ifade özgürlüğü ile din ve vicdan özgürlüğünün norm alanı belirlenecek; ardından İnsan Hakları Avrupa Mahkemesi (İHAM) ve Anayasa Mahkemesi içtihadı karşılaştırmalı olarak incelenecektir. Bu inceleme sonucunda, hukuken korunması gereken unsurun doğrudan dini değerler değil, bu değerlere inanan bireylerin hakları olduğu kabulünden hareketle; nefret söylemi veyaşiddet çağrısı niteliği taşımayan inanç sistemlerine yönelik eleştirilerin demokratik toplum düzeninin bir gereği olarak ifade özgürlüğü kapsamında değerlendirilmesi gerektiği sonucuna ulaşılacaktır.
