Abstract

Following numerous studies which have highlighted that the provision of information to and consultation of European Works Councils (EWCs) does not work well in practice, Directive 2009/38/EC on EWCs was substantially revised in 2025. The amending Directive 2025/2450/EU strengthens the participation rights of European Works Councils and, amongst other things, tightens the requirements regarding the minimum content of EWC agreements, the obligation to bear costs and improved enforcement of the law. In addition, transitional rules are being introduced for existing and very old agreements in order to bring them within the scope of the EWC Directive. This article outlines the development of EWCs and the practical problems identified in studies, and analyses the amendments to the EWC Directive. Furthermore, the need for action regarding its implementation in the Member States is highlighted.
